(the “Contest”)

OFFICIAL RULES

(the “Official Rules”)

            NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN THE CONTEST.  A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR NOMINEE’S CHANCES OF WINNING.  

  1. ELIGIBILITY.  Open to individual residents of Canada who have reached the age of majority applicable in their province or territory of residence at time of entry (each, an “Entrant”).  Individuals who are officers, directors, employees, agents and representatives of Parachute Leaders in Injury Prevention (the “Sponsor”) or Desjardins, any independent contest judges, as well as the immediate family members (defined as parents, children, siblings and spouses, regardless of where they live) and those with whom such officers, directors, employees, agents, representatives and judges are domiciled (whether or not related), are not eligible to enter or win a prize.  Sponsor reserves the right to verify the eligibility of an Entrant or potential winner. Void where prohibited. 
  • TO ENTER.  Internet access and valid email account required. From September 23, 2024, 12:00 AM (ET) to November 1, 2024, 11:59 PM (ET) (the “Contest Period”), to submit a Contest entry (each an “Entry” and collectively, the “Entries”): (i) go to https://parachute.ca/en/program/canadas-favourite-crossing-guard/nomination-form; (ii) complete the online nomination form (the “Nomination Form”) nominating a crossing guard (the “Nominee”), and upload up to four attachments (whether photo, drawing, testimonial or otherwise) that demonstrate why your Nominee exemplifies the judging criteria outlined below (collectively, the “Nomination Content”); (iii) provide your name and email address on the Nomination Form; and (iv) submit the Nomination Form. To be an eligible Entry, your Nominee must have reached the age of majority applicable in their province or territory of residence and must be a crossing guard appointed by a school (or other public authority) to enter public roadways in order to assist children and other pedestrians in safely crossing the road near schools or designated crossing zones. Entry through the online submission of the Nomination Form only; no other means of submission will be accepted. Your Entry must comply with Parachute’s terms of use, located at https://www.parachute.ca/en/terms-of-use-and-privacy-policy/. By submitting your Entry, you are indicating that you have read and accepted these Official Rules.

By submitting an Entry, you acknowledge and agree that your Entry (including the Nomination Content) may be posted online for public viewing.  You hereby irrevocably, perpetually and without limitation grant the Sponsor the unlimited right and permission to use, post, publish, adapt, edit and/or modify such Entry and Nomination Content (with or without your name in connection with your Entry) on the internet in connection with the Contest (including as promotional material regarding the winners) and waive all your rights, including moral rights, in and to the Entry and Nomination Content, without notice or compensation. By submitting an Entry, you further represent and warrant that you have all necessary rights, authority, power, consents, permissions and approvals regarding the Nomination Content required to grant the foregoing rights and permissions to Sponsor.

Limit one Entry per person.  Subsequent Entries from the same Entrant will not be accepted.  Each Entry must be submitted by the Entrant themselves.  All Entries must be received during the Contest Period; Entries submitted before or after the Contest Period are not valid. Sponsor is not responsible for lost, late, undelivered, invalid, unintelligible, incomplete, misdirected, illegible, or damaged Entries, which will be disqualified.  Entries (including the Nomination Content) become the exclusive property of Sponsor and will not be returned or acknowledged.

  • WINNER SELECTION AND NOTIFICATION. The potential winners of the Contest are the Nominees (not the Entrants). The three (3) winning Nominees will be selected by a panel of judges (the “Panel”), the composition of which shall be at the sole discretion of Sponsor and Desjardins, on or about November 25th, 2024 (the “Selection Date”) at 150 Eglinton Ave East Suite 308 Toronto, Ontario M4P 1E8. The Nominees shall be assessed and the winners selected based on the following criteria, as evidenced by the Nomination Content and the Entries (or other supporting material submitted by non-Entrants) endorsing a given Nominee: (i) amount of support shown for the Nominee; (ii) quality of the safety record of the Nominee; (iii) description of any proactive initiatives the Nominee has taken; and (iv) involvement of the Nominee in the community (collectively, the “Criteria”). The Sponsor will evaluate the Entries and create a selection of the top 5-10 Nominees from all valid Entries (the “Top Nominees”), and the Panel will make the final determination of the winners out of the pool of Top Nominees. The three (3) winning Nominees will be notified by Sponsor through their associated school. In order for each such Nominee to be confirmed as a winner, Sponsor may require such Nominee to sign and return a declaration and release, in a form prescribed by Sponsor, confirming such Nominee’s compliance with the applicable terms and conditions of these Official Rules and providing any necessary consents, permissions and approvals for the use by Sponsor of the Nomination Content and Nominee’s name, image and likeness in a manner described in these Official Rules, Sponsor’s privacy policy, and as is reasonably required to conduct this Contest. The Sponsor’s decisions on all matters relating to the Contest are final. If a winning Nominee (i) cannot be located and/or doesn’t respond to Sponsor’s attempts at contact within five (5) business days of Sponsor’s attempted contact, or (ii) does not sign and return a declaration and release within five (5) business days of Sponsor’s request, that Nominee and the associated school forfeit the prize, and an alternate winning Nominee shall be selected by the Panel. 
  • PRIZES.  There are three identical prizes to be won by Nominees. Each winning Nominee will receive $500 and an engraved plaque (approximate retail value: $50), and the school served by the winning Nominee will also receive $500. If a winning Nominee serves more than one school, the school affiliated with the majority of Entrants who nominated the Nominee shall be awarded the prize. Entrants do not win a prize, regardless of whether their chosen Nominee is selected as a winner of the Contest.

Prize is non-exchangeable, and the engraved plaque is not redeemable for cash. Sponsor reserves the right to substitute a prize for one of equal or greater value if a designated prize should become unavailable for any reason or for any other reason in Sponsor’s sole discretion.   Sponsor makes no representations or warranties with respect to any prize.  Sponsor shall deliver the prize to the winning Nominee and the school served by the winning Nominee. The winning Nominees and the schools served by the winning Nominees are each responsible for any other costs or expenses associated with their respective prizes (including any applicable taxes).

Any questions, comments or complaints regarding the Contest must be directed solely to Sponsor.  All trademarks are the property of their respective owners.

  • ODDS. Odds of a Nominee winning depend on the total number of eligible Entries received during the Contest Period and the degree to which the Nominees associated with those Entries meet the Criteria.
  • PERSONAL INFORMATION.  Sponsor and its authorized agents will collect, use, and disclose the personal information of the Entrant provided on entry for the purposes of administering the Contest and prize fulfillment.  By entering the Contest, you consent to such collection, use, and disclosure of your personal information. You may also be offered the opportunity to receive additional communications from Sponsor about its products, upcoming contests and promotions.

  • RIGHT TO VOID / MODIFY / SUSPEND.  Sponsor reserves the right to terminate, suspend or modify the Contest, or these Official Rules, in whole or in part, at any time and without notice or obligation if, in Sponsor’s sole opinion, any factor interferes with its proper conduct as contemplated by these Official Rules. Without limiting the generality of the foregoing, if the Contest, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, in the sole opinion of Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor may, in its sole discretion,void any suspect Entries and: (a) terminate the Contest or any portion thereof; (b) modify or suspend the Contest, or any portion thereof, to address the impairment and then resume the Contest, or relevant portion, in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the prizes to Nominees from among the eligible, non-suspect Entries received up to the time of the impairment in accordance with the winner selection criteria discussed above. 
  • LIMITATIONS OF LIABILITY AND RELEASES.  By participating in the Contest, Entrants agree to release and hold harmless Sponsor and Desjardins, together with their  respective affiliates and related companies from and against any and all claims, losses, injury, death or damage to persons or property, arising out of or relating to (a) entry or participation in the Contest, (b) any claims based on personality or privacy rights, defamation or prize delivery, or (c) the possession, use, misuse, or redemption of a prize or the merchandise for which it is redeemed.  Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; therefore, such exclusions may not apply to you.
  • GENERAL CONDITIONS.  Participation in the Contest constitutes agreement by Entrant to these Official Rules.  Entrant’s Nominee winning a prize is contingent on Entrant fulfilling all the requirements set forth herein.  All Entries and prize claims are subject to verification. Proof of Entry submission does not constitute proof of receipt. Entrants agree to abide by these Official Rules.  The Contest is subject to all applicable federal, provincial, territorial and municipal laws. Void where prohibited.  Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision were not contained therein. Sponsor reserves the right to disqualify any Entrant where it is suspected or evident that tampering with the Contest operation, or a violation of these Official Rules, has occurred.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Official Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Contest entry form, and/or advertising or any French version of these Official Rules, the terms and conditions of these English Official Rules shall prevail.
